District Court Fees Schedule

The following chart of a typical District Court action shows where fees are payable. 'Item' numbers below refer to items set out in the District Court (Fees) Regulations 2002 (WA).

Fixed costs in liquidated demands

Where the plaintiff’s claim is for a debt or liquidated demand only, the writ before it is issued must be indorsed with a statement of the amount claimed in respect of the debt or demand, and for costs up to and including service: Rules of the Supreme Court 1971 (WA) (RSC) Order 6 rule 4.

If in a claim of this kind the plaintiff is entitled to enter default judgment, it may do so with costs fixed: RSC O13 r2. The schedule sets out the maximum amount of costs which the Court will accept for these purposes.

Reduction of Fees

There are reduced fees payable for small business and non-profit associations. To be eligible for these you will need to complete and submit a Form 1 (Declaration that a person is a small business or a non-profit association).

If a fee is payable, a party may apply to have the Court defer, refund or reduce the fee. The application can be made by submitting a Form 2 (Application to Reduce Fees). The application is not required for a party in possession of a valid concession card seeking to reduce a filing fee, as this is an automatic process via the Electronic Document System (EDS).
